Meaning you didn't report the accident to your carrier? Minimally you have put yourself in a bad light with your carrier. Worse case scenrio? Your insurance contract says you must promptly report all accidents, there is the option/possibility that they could deny the entire claim for your failure to promptly report it. Call it in right now.

If we're not at fault and the insurance decides to total our car do we have a right to a rental car until we get the money?

It would depend on your insurance agreement. Some policies include free rental car in cases of accident, others don't. On some policies you can choose it as one of your options.

Can you resolve a minor car accident without going through insurance?

That is usually up to you and the other party involved (if any), and it will highly depend on the extent of the damage. The worse the damage, the more likely you and/or any other party will be legally required to report. Generally, if an accident is multi-party, prudence dictates reporting: in the event one party decides to file claims or legal action later on.The option to fix the results of an accident yourself is more likely to be available if the accident is single-party (meaning the accident involved hitting a stationary object). Some may wish to employ this option for minor damage because either the cost to repair is too close or even under a deductible or because reporting such an incident can result in increased premiums.

Concerns For Drivers?

Like every other state, driers in Kansas have to have insurance if they want to drive a vehicle. The minimum liability rates are 25/50/10. A policy that has $25,000 for the driver of an accident is the least a driver can get on their policy. The minimum for everyone involved in the accident is $50,000. This is usually a maximum amount for the people who are involved. Property damage rates are kept at a minimum of $10,000, but drivers can get a higher coverage, especially if they are younger or an elderly driver. Something that Kansas offers to its drivers is a no fault policy. This means that everyone involved in a car accident has their medical bills taken care of. An amount of $4,500 is awarded for each person involved in the accident. The coverage also includes loss of wages if the person has to stay out of work as well as rehabilitation expenses. In the event that someone dies in an auto accident, $2,000 will go toward funeral expenses. If there are any survivors of the person that passed away in the accident, they will be awarded up to $900 a month for one year. This seems like a reason that many people would have a car accident on purpose, but in the state of Kansas, if you have a car accident, your insurance rates will go very high if you are in an accident. Therefore, because of these regulations, there are very few auto accidents and insurance rates are kept low. When a driver decides it is time to get car insurance, or if they are changing form one carrier to another, there are a few factors that will determine how much they will pay. The first thing the company will look at is the prior driving history of the person applying. The company also takes into consideration the type of vehicle that is to be insured as well as the age and gender of the driver. If approved for coverage, the driver is placed in a category of drivers. There are three categories that drivers can be placed in. The lowest rates are for those considered to be the safest drivers.

What is claim In adjudication?

Claims adjudication is generally a term found in insurance. It is the process in which the insurance company decides whether or not to pay out on the claim.

How exactly do car insurance companies use accident reports?

They use them as another version of the event. If they investigate the claim properly they will talk to the driver of each vehicle and any witnesses. Then they will look at what the police officer put in their report and take into consideration any violations that were issued by the police. Lastly the insurance company decides whether to accept liability or not for the damage.

Is there any recourse if your auto insurance company decides not to cover you if you have an accident in a rental vehicle?

Your insurance company did not just decide not to cover you if you have an accident in a rental vehicle. You policy does not provide you with this type of coverage due to the circumstances. You could have prevented this situation by calling your insurance agent and asking this question before you rented the vehicle. If you were just renting a vehicle you could have paid the extra few dollars to the rental car company for physical damage deductible waiver coverage. There are several things you should have done before renting a vehicle that would have prevented this situation.
