I believe you used to be able to marry an illegal immigrant and they would not have to leave but with the changes in Federal Laws for national securit I believe that has changed now and they would have to apply for citizenship like everyone else
If you are a US citizen and marry an illegal alien who entered the country with a valid VISA, he would not have to leave the country. You would have to have his status adjusted so he would no longer be in the US illegally, however.
