If a judge and a lawyer are under trial, they shouldn't be practising. You can probably apply for a mistrial or something, under conflict of interest or incompetency.

Can two people hire the same attorney to handle the same criminal case they are both involved in?

It is customarily not allowed because the interests of the two defendants may, at some point, not be the same, and a single attorney would have a conflict of interest in attempting to defend two defendants with different interests.

Is it a conflict of interest for a divorce attorney to hire a client and continue to represent them in cases related to the divorce?

The question is a little confusing, but no, it's not usually a conflict of interest for an attorney to represent someone who works for them, or who is also a client they're representing in other cases. (After all, an attorney is supposed to do the best possible job for their client.)

My attorney did not disclose he was partners with the opposing attorney. Is that a conflict of interest?

Yes. In the states I practice in it is definitely a conflict of interest and must be completely disclosed and the client given the option to find other counsel. If you are unhappy with the settlement, you should file a grievance with the state bar commission.

Can an attorney oppose you if he defended you in a previous case?

It depends on the exact circumstances. Having represented you in a specific case ten years ago does not necessarily mean the attorney could not be on the opposite side now in a completely unrelated matter. Many attorneys will avoid this even when it's not technically illegal in order to avoid even the appearance of a conflict of interest.

What do you call it when your attorney starts treating you the client with contempt?
