I am in the same situation. My fiance was here and left voluntarily and although USCIS approved my petition for a K1 visa, they denied his visa for having been in the US for over a year so they banned him for 10 years with a denial of obtaining any waiver or pardon until he completes the 10 year ban. It doesn't matter if you have hardships they won't allow you to waiver that decision which is the form I-601. I asked lawyers if there was anything I could do and they said no, I even contacted the consular office in Mexico and they told me the same thing, I keep hitting a brick wall. So basically as far as I've been told so far, there is nothing we can do until he completes the years he is given then maybe you can petition him/her again.
