Not if they were telling the truth. Most employers don't because of the possibility that a court might see things otherwise, but truth is the ultimate defense in court.

If the head of HR is not addressing the issue, then your only recourse is to speak to the supervisor above the upper management person in your question. However, if HR is not responding to this issue, there must be a reason. You could be placing yourself in a bad situation if you push too hard against management above you. It isn't right, but it may be safer to document what you can and sit on it. Perhaps there will be a change in HR management sometime later, and then you can turn over your documentation.
