Yes. If the evidence is available and can be corroborated then it is possible for criminal proceedings to be successful in a Court of Law without the victim's cooperation. Whether the Procurator Fiscal decides it is in the public interest to proceed with formal court proceedings or to use one of its alternative forms of justice (fiscal fines, fiscal warnings etc.) is another matter and will be based on a wide number of factors.
