Probably not; it depends on what the court arranges for you.

Cancellation of chapter 7 bankruptcy?

You can dismiss a bankruptcy. (Motion to dismiss) However, you will no longer be under the protection of the bankruptcy courts, will still owe everything, and will still have a bankruptcy on your credit report. You may also be prevented from filing again for quite some time. Talk to an attorney about your individual circumstances and how your local Bankruptcy court handles these situations.

If an account was not listed on the creditor's list of a chapter 7 is it still dischargable under the bankruptcy?

Yes it is. The presumption of bankruptcy is that all of the bills that were owed will be discharged at the time. If for a reason the bill that wasnt listed came up it can still be discharged by the court. Your attorney can file an addendum for this with the court after wards.

Can you cosign for a car if you are filing for bankruptcy in the future?

If you are filing for bankruptcy, and you try to cosign -- two things can happen. 1. the lender will turn you down. 2. If the court finds out you have applied for credit the bankruptcy can be stopped. If you mean that the car and loan will be for you during or after the bankruptcy, this still has to be disclosed and again the bankruptcy can be stopped.

Can a debt collector still collect your debt if you file chapter 13?

No they cannot, as long as you included them in your bankruptcy. They would be in violation of Federal Law, and liable to suit and possible penalty from the bankruptcy court. The bankruptcy attorney, or the trustee should be notified about any collections on a bankruptcy account.

Can you file bankruptcy while still owing back taxes?

Yes, as a general rule. Taxes of all kinds are not discharged by the bankruptcy process. That means, when it's all over with bankruptcy, you still owe taxes to the federal gorvernment, and any other government. In short, fiiling a petition in bankruptcy and a subsequent discharge will not get you out of paying taxes to the government. It's really easy to filing a petition in bankruptcy; it's very expensive not to do it right; the Bankruptcy Court is just not the same as your Magistrate's court, or the small-claim's court. It's very expensive to do it wrong and you cant do it but every so often (time limits: you just have to see the code. If you have a bankruptcy sitution you really need to see a lawyer who works with bankruptcy.

How do you find out if someone has filed for bankruptcy?

Bankruptcy court records are public records, unless the court has impounded some or all the information for some good reason. There are banking publications, like Banker & Tradesman, that publish all filings in their area. Some local newspapers still publish bankruptcy filings from their communities. And you can check out the bankruptcy filings at the bankruptcy court for your area. There is usually a public access computer in the clerk's office where you can look for filings by name. A deputy clerk will be happy to assist you.

Is child support taken during a bankruptcy?

In general, bankruptcy stops debt collection, at least temporarily. However, child support debts are not discharged in bankruptcy - the bankrupt person still owes whatever support was ordered by the court(s).

What happens to the garnishments after you filed bankruptcy?

If they were ordered by the court (i.e.: child support - back taxes - etc) you must still honor them, bankruptcy will not do away with court ordered liens. . Liens placed by private persons or businesses will have to take their place in your long line of creditors. As soon as you file, you take the papers from the bankruptcy court showing that you filed to your employer and the garnishment will stop. There are some exceptions to this.

Who can apply for car loan after bankruptcy filing?

Assuming the bankruptcy has gone to discharge, the debtor can apply for a car loan almost immediately, as long as the income is enough to qualify. You will pay a high interest rate, though, if you make the payments on time for a year or so, you may be able to refinance. Watch out for "we finance here" dealers. They are often not licensed as lenders and will have you sign a document with a lot of blank spaces. Don't do it. Go to a credit union or a small local bank, if possible. If the bankruptcy is still pending, you need permission from the court.
