The eMule program itself is legal. Like any filesharing program, some of the uses to which it is put may not be. If you're using it to downloaded copyrighted movies or software, that's illegal, though the software itself is not. If you're using it to download, for example, Debian (maybe that's a bad example, because that's technically under copyright, just an extremely permissive one), then it's prefectly fine.
