I'm going to take a general shot at this. I would have to say No you are not in contempt in this case. Reason being is that his girlfriend probably does not have legal custody of your son and therefore is not legally binded to that child. So if he is not home, you legally should NOT have to leave your child with his girlfriend unless stated in writing from the courts. You both have legal custody of your son. Check with a lawyer or your local laws regarding this further.

Good for them that they enjoy being together and that no sex is involved. After all, sex is not a prerequisite to friendship (or any other thing, except for having a child).
