Easier to say which are prevented from discharge...although being allowed does not mean being allowed and done in every case. Gov't debts, Child Support, most civil type penalties and fines, Gov't insured student loans.

Debts that can never be discharged?

There are certain debts that can never be discharged under any type of bankruptcy. This should be a factor in your decision because the debts will not go away and they will continue to collect interest even during your bankruptcy. Some examples of nondischargeable debts include: * All debts not listed in the bankruptcy petition * Student loans - unless undue hardship to repay* Taxes - Federal, state, and municipal* Fines for violating the law: including criminal fines and traffic tickets* Alimony and child support* Debts for personal injury caused by driving while intoxicatedSee the related link

For the most part, it should stop any collection actions unless it falls under the category of nondischargeable debts. Are utilities in chapter 7 bankruptcy dischargeable debt?

No type of bankruptcy, whether chapter 7, 11, or 13 discharges a civil or criminal judgment against you. Those are considered non-dischargeable debts and will remain with you until you pay them. Be sure to familiarize yourself with what will and will not be discharged before filing for bankruptcy as you may find that much of your debt is nondischargeable in which case bankruptcy may not be the option for you.

Does a bankruptcy 7 discharge state and federal tax liability?

Not Exactlly:Debts are divided into two categories; dischargeable and nondischargeable. Dischargeable debts are those that the debtor is no longer personally liable to pay after the bankruptcy proceedings are concluded. Nondischargeable debts are those that are not canceled because of the bankruptcy proceedings. The debtor remains personally liable for their payment. As a general rule, there is no discharge for you as an individual debtor at the termination of a bankruptcy case for the second and eighth priority taxes described earlier, or for taxes for which no return, a late return (filed within 2 years of the filing of the bankruptcy petition), or a fraudulent return was filed. However, claims against you for other taxes predating the bankruptcy petition by more than 3 years may be discharged. However, if the IRS has a lien on the debtor's property, this property may be seized to collect discharged tax debts.Yes, taxes, any penalties along with or interest thereon are each given their own category and status in the BK and may be dismissed.

At what point in a Chapter 7 bankruptcy is it considered final with no new debts eligible for discharge?

When you file for Chapter 7 bankruptcy, you are responsible for listing all of your debts. Some debts are generally not dischargable (i.e. child support, most taxes, student loans, secured debts, etc.). When you receive a discharge for dischargeable debts, the discharge generally applies to debts listed in your bankruptcy filing and any subsequent amendments. The discharge does not apply to date incurred after you filed bankruptcy and generally does not apply to debts that you failed to list in the bankruptcy.

Can collection agencies pursue you for debts incurred after you have filed a bankruptcy?

NO NOT IF THE DEBTS ARE IN THE BANKRUPTCY. If they are included in the bankruptcy, give them your case info/ lawyer's name. After that they can be fined if they continue to call. If the depts are incurred after the bankruptcy then yes they can.

Will filing bankruptcy eliminate criminal court fees?

If you are sued and a creditor gets a judgment against you, you may be able to discharge your personal liability on that judgment in a Chapter 7 bankruptcy. This will depend on whether the underlying debt is dischargeable (meaning you can wipe it out in bankruptcy) or nondischargeable.

After bankruptcy are you still liable for old debts?

It depends on which debts are discharged in your bankruptcy. There are several types of debts, such as student loans, which consistently persist through bankruptcy. Moreover, you may be liable even for debts that traditionally are discharged, such as credit card debts, where there is even of bad faith and manipulativeness on your part, i.e. you racked up thousands in credit card debt in the days before filing for bankruptcy.
