A Bill of Rights would overwrite some current laws and acts. This is undemocratic because the people would have voted for a law, that would be overwritten by a Bill of Rights. For example, the Serious and Organised Crime (Control) Act would be overwritten because it clashes with the Bill of Rights. The Serious and Organised Crime (Control) Act states that gangs are not allowed assembling together because they cause disruptions to the community. This clashes with the freedom of assembly, which would be protected by law if Australia has a Bill of Rights meaning that The Serious and Organised Crime (Control) Act would be made void. Then gangs such as bikie gangs would be allowed to assemble and may cause trouble.
There is no Bill of Rights in the Australian Constitution. There have been numerous pushes to achieve one.
The advantages of having a specific Bill of Rights in the Constitution is that there is a sense of structure. The disadvantage is having to remain loyal to it which at times can prove difficult.
