Actually the odds could be 100% if the woman's husband owned three different life insurance policies naming her as the primary beneficiary for each of the policies. Or, perhaps her parents each owned life insurance policies, as well, and named her as the primary beneficiary.

Does an insurance policy supersede a will in nc?

An insurance policy and a will are two separate things. The policy is a contract between the insured and the insurance company. The beneficiary of the insurance policy is spelled out in the contract. The insurance company will pay the insurance proceeds to whoever is listed to receive the proceeds. The proceeds from an insuranc policy can be paid into the estate of the deceased and disbursed according to the terms of the will. The issue is who is listed as being the beneficiary of the insurance policy.

Can a life insurance beneficiary defer the proceeds to the secondary beneficiary?

Any answer to this question would have two conditions the first being the jurisdiction under which the policy operated. The second condition would be the form in which the insurance payout was proposed it could be either paid direct to the beneficiary or to the estate of the deceased. The important point being why would you want to go about the insurance payout in this manner?

What if there is not an estate to pay for the funeral does the beneficiary of life insurance policy have to pay?

The life insurance is part of the estate not separate from it. In the UK and most other countries, all debts starting with the funeral expenses must by law be paid first from a persons estate. Once all funeral costs, debts and expenses are paid from the estate, only then can any monies be paid out (if there are any left after payment of such bills and expenses).United StatesWhen the decedent named a beneficiary on a life insurance policy the payout goes directly to the beneficiary and is not considered part of the estate. Being a named as a life insurance beneficiary does not oblige the beneficiary to pay for the funeral. The next of kin, if any, must pay for the disposition of the body. If the beneficiary is also a next of kin you may be successful in suing them for their share of the expenses.

Can a claim on your dead husbands estate also include life insurance to spouse?

If the life insurance policy had listed as the beneficiary the spouse only then it is not considered part of the estate and is not subject to claims. If the beneficiary is the estate then it is subject to claims. The only problem with the spouse being the only beneficiary is if she was a party to the claims personally then perhaps she and the proceeds from the life insurance could be subject to these claims.

Does New York allow spouses to have separate auto insurance policies?

NY and Auto PoliciesYou can have separate policies, but most of the time, it is cheaper to be on the same policy. A NY Insurance Company will ask the question of being married, and if there are other licensed operators in the household, regardless of if they drive the car. It is always said that if there are others in the household that they do have access the the vehicle (last car in the driveway theory). If you commit fraud, you can be denied a claim.

Is it legal for a life insurance company not to pay benefits to a common law wife?

Who is the beneficiary on the policy? insurance companies state "spouse" in all of their paper work, and you can not be a spouse without being legally married. i suppose it has to do with people being able to take out policies on each other without having legal rights to do so. common law is not considered a legal marriage between two people.
