If he isn't signing, it's because he doesn't want you to get the separation. There are procedures your County Clerk can tell you about regarding filing for separation, and probably they have a Q&A web site as well. His not signing does not have to stop you. You can have him served with the papers regardless of what HE wants. Find out how you proceed from the above sources, or attorney, and go ahead and DO IT.
