Contact the seller and tell them if you don't get a full refund, you'll be reporting them to both eBay and the police for fraud.
If the refund is not immediately forthcoming, then carry through on the threat.

Yes, you can and are allowed to do that. Many seller's do just that, buy from other eBay seller's, turn around and make money off of what they bought.

if you go on eBay you can find out if the seller has shipped it yet and you can track the order to find out when it will arrive for you
Since eBay (not the seller) issued the refund and you have already been refunded, you are not responsible for returning the item. If you had not been refunded yet, and the seller was going to issue the refund themselves, they had the right to ask for the item to be returned before issuing the refund. In this instance, however, this is not the case. Unless eBay or the shipping company asked for the item, you don't need to return it.

You can't usually search for stuff that's already been sold on ebay. But if you know a seller who has sold multiple items you can look through their feedback which lists all the items sold and had feedback on, which will let you see what they've sold.
One has to be careful if they are shopping for used tires on eBay. Trust is a big issue, you can never be sure to trust the ebay seller. you would have to do alot of research.
