Near the top of the brake pedal pendulum is a push-switch when the brake pedal is moved this switch will trun the brake lights on and off.

If it is out of adjustment it will give a constant signal as if the brakes were being applied. Try adjusting it to see if that solves the problem. If not, it will need replacing.
