If you refuse to submit to a chemical test for intoxicants, you will lose your driver's license for at least six months and for as long as three years, depending on the state and the circumstances. In some states, you can be physically compelled to submit to a test. If you refuse to choose between a blood or breath test, force can be used to obtain the blood for testing.

Your driver's license is going to be in serious jeopardy, and they are probably going to take you to jail anyway, if they can smell your breath or you have bloodshot eyes, or any other positive indications that they have enough to arrest you. It's really a catch-22. If you don't pass, you were going to be arrested anyway, plus they have evidence that they can use to prosecute you later. If you refuse, they can bring it up in court that you refused the test, which sounds guilty.

Lawyers often say refuse to submit to a test until you can speak to an attorney, because it makes it easier to defend you later, but of course the best thing to do is not drink and drive at all. A DWI can cost you ten thousand dollars, if not much more... even if you manage to get your license back. Cabs are much, much cheaper than that.

Refusing to submit to a sobriety test is your right by law true or false in Florida?

You can refuse a field sobriety test and that is your right and you cannot be punished from refusal alone. If you refuse a blood or urine or breathe test then you automatically have your driver's license suspended for a year.

Do you have to submit to a sobriety test when asked by a law enforcement officer?

Yes, in most countries you will have to do the test. If you refuse, the officer is usually empowered to arrest and take you to a police station for a blood test.

When can a police officer ask you to take a sobority test?

A police officer needs only reasonable suspicion of driving while intoxicated to ask you to submit to a sobriety test, actually called an SFST: Standard Field Sobriety Test. You are not obligated to submit to such a test. However, if you do not take the test, the officer will act on the observations he has already made of your behavior, and may arrest you for driving under the influence. He will then ask you to submit to a breath or blood test. If you refuse one of those, you will have your driver's license revoked.

In a collision where there is severe injury or death You may refuse a sobriety test?

Can you be arrested for DUI and be taken to jail if you refuse to submit to test for the presence of alcohol or drugs?

Yes, if you refuse the breathalyzer or other field sobriety tests you can be booked for that and taken to jail. Usually you will have your license suspended for 6 months to a year depending on the laws of your state.

In Florida refusing to submit to a sobriety test is your right by law true or false?

you can always refuse a sobriety test no matter what state, but when u do so the fine u get is nonnegotiable. ====== Most states have what are known as implied consent laws, where, by driving on public roadways within that state, you essentially acknowledge your consent to be rendered a field sobriety test if pulled over. Refusing to take a field sobriety test will lead to arrest, and a good chance that a warrant will be obtained for them to take a BAC reading by means of involuntary blood test, as well as additional charges.

If you refuse to submit to a test for the presence of alcohol or drugs can you still be arrested for DUI and taken to jail?

Yes, if you refuse the breathalyzer or other field sobriety tests you can be booked for that and taken to jail. Usually you will have your license suspended for 6 months to a year depending on the laws of your state.

Is it better to refuse to take a field sobriety test than to take a chance on being convicted of a DUI?

true

What to do if the police denies sobriety test?

It's not a sobriety test, it's meant to prove that you are intoxicated, not prove your sobriety. If you deny your field sobriety test or breathalyzer you can get your license suspended.

Refusing to submit to a sobriety test is your right by law true or false?

It depends on the state, but all the states I know have what is called an implied consent law. Basically most of these laws state that by having a license in the state you consent to comply with a breath and blood test. If you refuse they can suspend your license for up to a year. How long do police have right to aske for a blood alcohol test after an accident?
