If you are observed by a police officer running a red light a traffic ticket cal be issued and in some states your car insurance cost will increase. You can also cause a serious accident.

The person who caused the collision is at fault. If someone ran a red light he/she gets the points on his/her license and his insurance gets to pay the damage. The unlicensed driver just gets the ticket to force him/her to get a license.

The driver can be charged with hit & run, failure to maintain lane, and whatever other charges apply. The vehicle owner and the driver could both be liable for the damage, depending on a number of factors and applicable law.
Personally I would sue the person for damages in a civil court for payment of the repair or replacement of the car.
