Taxpayers can always request a copy of their Wage & Income Transcript from the IRS each year. This report provides you with everything that has been reported against your social security number for the current year. The IRS compares your Wage Transcript against your file return each year. If you do not receive a 1099-C in one year, then there is a possiblity that the company issuing the 1099-C could report it in the next year. I would highly suggest that all taxpayers request a copy of their transcript so that they report everything. In a case where you receive the 1099-C but the company does not send it to the IRS, you are still legally bound to report the debt discharge. Sharon http://taxresolutionaries.blogspot.com

Q: What if a creditor doesn't send you a 1099c form how will I know if they intend to send this to the IRS and will I be responsible for the debt if it is not sent to the IRS?

No, it means you 'gained' income by not paying the money back. The IRS wants to tax your income so the 1099 is telling them how much you benefited.

What should you do if you got a 1099C from a creditor even though you paid them off in full in August and they didn't write anything off?

Call first of course, but send them by certified mail, a copy of your payoff info and request they correct their records and acknowlege doing so by sending an Amended 1099C, (it may actually have a form number like 1099C-AMD). They aren't going to like doing so, because making amended filings for them is always a time consuming and expensive process, but they would have to. If they respond with any reasons they believe the 1099C you received is required, you can deal with that. If they don't respond or send the amended, the documentation you have should become part of your tax records and would appear to be sufficent to show your acting properly in not reporting the income.
