The first storytellers knew they were not really telling a genuine account of the first man. And they knew there was not really a talking snake. This was a moral tale that was based on even earlier Near Eastern creation stories. Leon R. Kass (The Beginning of Wisdom: Reading Genesis) says we can learn most from the story by regarding it as mythical and looking for the moral truths it tells about humanity, rather than regarding it as some sort of historical account. We should not begin a search for the type of snake in this story, when there was none.

I am guessing that you mean that when does it first appear, it is as a serpent. In the story of Adam and Eve, the serpent is the one that tries to deceive Adam and Eve into eating the forbidden fruit. He eventually convinces Eve to eat the fruit and Eve convinces Adam to eat the fruit as well. They then were made to leave the garden because of their disobedience to God.

Snakes of today actually have vestigal legs inside them. Unlike snakes of today, Satan was a beautiful shining and irridescant creature walking on 2 legs. (Anyway, would you trust a talking snake?)

The devil did not appear in the Garden of Eden. The story describes a snake, or serpent, as deceiving Eve into eating the fruit of the Tree of Knowledge of Good and Evil. Because of this God punished the snake and all his descendant by making them crawl on their bellies (Genesis 3:14). If it had not really been a snake, but simply the devil disguised as a snake, then the devil was easily able to deceive God himself. Is that theologically sound?
