The system of checks and balances has been criticised by many as being too weak. Examples of this include:


1. The President exploiting his role as commander in chief to declare war, instead of Congress doing so (as described in the constitution)


2. The growth of judicial review means that the Supreme Court have an almost uncheckable power to decide what is and what isn't unconstitutional, this could affect the whole of the country.

3. The governing party can control both Congress and the White House office, meaning that both the executive and the legislature can work together and almost become fused. This happened in 2002-2006 when the Republican party had control.

4. The president can adapt and change the intention of Congress through his signing statements which he issues after signing a bill into law.

5. The president can also find a way around government through executive orders, executive agreements and also recess appointments.

Overall

you have to remember that the constitution has worked for the past 200 years and continues to do so.
