The judicial branch does not make the law, they only interpret existing law. The legislative branch (Senate and House) write Federal Laws. The executive branch (White House plus all bureaucracies) enforce the laws. Only when the law is ambiguious for a given set of circumstances will the courts interpret the law to best fit the legislator's intent. Justice Souter is famous for 'Judicial Activism' which means looking to all evidence outside the written law to determine what the legislators meant to do when they wrote the law. Case law refers to a set of court cases interpreting a law (for example, the Free Speech clause of our First Amendment). Therefore, case law (jurisprudence) can be washed away completely if a new federal law is passed (for example, if the First Amendment were to be repealed or replaced).
