Silencers (also known as suppressors) are regulated by the Federal government under the 1934 Gun Control Act. Ownership by a private citizen is prohibited by State law in California, Minnesota, Iowa, Illinois, New York, New Jersey, Vermont, Massachusetts, Delaware, and Hawaii. Possession in states not named is permitted, so long as the silencer is registered with the Federal BATFE, and the $200 transfer tax paid.

Another View: The possession of "silencers" is licensed by the BATF. You may apply for and receive permission to own/possess one but you cannot sell it or transfer its ownership without notifying the BATF for permission.

There are many states in which it is legal for a certified gun owner to purchase a silencer. Some of these states that allow a gun owner to do so are Arkansas, Alabama and South Dakota.
