It would take good evidence that GMO foods differ from their natural counterparts in terms of safety or nutrition. The best evidence available currently suggests that GMO foods are equivalent to natural foods in these terms. The food is therefore unlabeled, because the information a label would convey is irrelevant as far as consumer choice goes.

That's the science end of it anyway. I can't speak much to the legal end.
