I would suggest you have the transmission serviced. A complete fluid and filter change. If after doing this, you still have the problem, take it to a professional. Do not ignore this as you may end up with more problems later on.

You need a engine scaner so you can scan the transmission. so you can see whats going on with it. CHECK THE FLUID If engine is running bad it can cause the trans. to act up badly. Need to fix engine running problem first if that's the case.
All that is required to restart a 2006 Cummins is to add fuel and crank the engine. The fuel system is self bleeding.
A bad EGR valve should not cause the engine to not start. There is most likely another problem that is causing the engine to not start.
Add gas, crank engine. If it doesn't start in about 30 seconds, it was not out of gas and you have a different problem.
