Gays and lesbians have always had a right to raise their biological children, which includes children born through in vitro fertilization. The only way a child could be taken away was if the home was deemed unfit, which could happen when homosexuality was illegal. Gay men and women who were arrested for homosexual conduct could lose their children, although no law explicitly stated that they couldn't be parents.
In the late 1970's, some states began to allow second-parent adoptions, where Parent 1 had a child and their partner adopted that child. Joint gay adoptions are currently a protected right in 19 states. An additional 3 states allow for second-parent adoption. 5 states prohibit gay adoption of any kind, and the rest have no clear legal guidelines for or against gay parents.

Well, being gay has absolutely nothing to do with being a parent. Parenting is about the child, not about you. You and your ex-spouse have to find an arrangement where you are both focusing on the child's needs and not on each other or on yourselves, in terms of your parenting.
