Article II, Sec. 2, second paragraph. President can 'choose candidates' and the Senate must approve, or "concur," by a 2/3's vote. Note, however, in the third (next) paragraph, if the Senate is not in session (or in 'recess') when a vacancy occurs, the President can appoint a judge, etc., to fill the position. This appointment, unlike many/most judicial appointments, expires and is not a lifetime appointment.
