Well, "West Virginia" didn't exist when the Civil War began in 1861, so that can't be the answer, but that's probably what you are looking for. The mountainous parts of northwestern Virginia were not at all supportive of secession, and many counties held de-facto Union sympathies. These counties rebelled against the rebels to remain part of the United States. Technically, this was an unconstitutional act, because Article IV, Section 3 of the Constitution states: "no new State shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or Parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress." The State of Virginia certainly didn't consent to this, but being in rebellion at the time, the Union Congress took no heed of Virginia's objections.

The Union admitted the new State of West Virginia on June 20, 1863.
