The Judicial Branch of the government, which is divided as various courts on the state level and as the Supreme Court on the Federal level, decides whether laws are Constitutional or not.

The Judicial Branch of the government decides whether or not the laws created by the Legislative Branch are constitutional. This branch consists of the Supreme Court and all the lower federal courts. Supreme Court justices are appointed by the President and confirmed by Congress.

The judicial branch is the main actor that decides whether or not an action of the government is unconstitutional. However, technically the President can decide not to enforce parts of a law Congress passes on the basis of unconstitutionality through constitutional signing statements.
To my knowledge it must be the Judicial Branch because the judicial branch carries the Supreme Court and their ones who decides if a law is constitutional.
