Japan was almost destroyed when the nuclear bomb were deployed. Tokyo and Kyoto were bomb with fire bombs which had more casualties than the nuclear bombs but compare the two, the nuclear bomb were more potent.
It is illegal for private individuals to prepare bombs of any type. But countries can do what they want to. Ownership of highly enriched Uranium, Uranium-233, or Plutonium by private individuals is illegal in the US and probably several other countries. Without one or the other no nuclear bomb can be built.

Neither the US nor Russia are making nuclear weapons of any kind at this time. Other countries however are making nuclear weapons; some are North Korea, India, and Pakistan.
