Yes. It is perfectly legal for more than one state to have the same state bird. For example, Illinois, Indiana, Kentucky, North Carolina, Ohio, Virginia, and West Virginia all have the same state bird - the Cardinal. No matter how many states have previously used it, the Cardinal can still legally be used as another state's emblematic bird.

Illinois, New Jersey, Rhode Island, and Wisconsin all have the violet as their state flower. However, two of them (Illinois and Wisconsin) actually have a variation of the violet. Illinois's variation is called the Purple Violet, while Wisconsin's is called the Wood Violet. So, in a sense, only two states actually have the same violet as their state flower.
