Under the Act of Succession 1543, Henry's only surviving legitimate son, Edward, inherited the Crown, becoming Edward VI. Since Edward was only nine years old at the time, he could not exercise actual power. Henry's will designated 16 executors to serve on a council of regency until Edward reached the age of 18. The executors chose Edward Seymour, 1st Earl of Hertford, Jane Seymour's elder brother, to be Lord Protector of the Realm.
In default of heirs to Edward, the throne was to pass to Henry VIII's daughter by Catherine of Aragon, the Princess Mary, and her heirs. If Mary's issue failed, the crown was to go to Henry's daughter by Anne Boleyn, Princess Elizabeth, and her heirs.

Technically she was the true queen as Henry VIII's 1544 act of succession left the throne to Edward and if he died without children it would pass to Mary. Edward's 'devise for the succession' was therefore illegal in a sense because it had not been passed through parliament and as he was still in his minority it would be unable to override the act put in place by Henry VIII. So once Edward died Jane came to the throne and held it for 13 days (contrary to the common belief that she was the '9 day queen') and she was not crowned during this time. Then she was overthrown by Mary who became England's first crowned queen regnant.
