I would say probably the person backing out, as they should of looked for any oncoming cars before backing out. ---- The person backing out of the driveway who did not yield to oncoming traffic.

No even if they did hit you it would be the fault of the person who hit the other becaue they were following to closely.
When turning left, you must yield the right of way to oncoming traffic. There is no such thing as left of way, unless you are protected by a green left turn light. Always wait to see what the oncoming traffic is doing before turning left. Remember...there is no such thing as "left of way".
Not sure about NY, but I believe the first vehicle that approches the intersection goes first, followed by the others in order of arrival at intersection. Unless two or more people come to the intersection at the same time then its the person to the right. once the first person has cleared the intersection.
