The person who hit the second car is At Fault if evidence shows that such happened. If the person ran after the collision, and cannot be located, your uninsured motorists coverage would take the place of the person's insurance as if they stayed and were deemed at fault. The police would determine what actually happened.
The driver who rear ended you is at fault.
If there is insurance coverage on the at fault vehicle, there should be no reason to file small claims. If the at-fault party does not have insurance, then small claims is an option.
claims if you are at fault in a collision.
If the accident was not your fault (someone rear-ended you, for example), then you would claim on their insurance, and they would pay out.
Same thing happened to me in CA & we were found to both be at fault....
If he was at fault, regardless of whether he was pulling a camper or not, he would be responsible. Pulling a camper doesnt make you responsible for an accident if that was the only thing you did wrong. If someone rear-ended him, its their fault, if he rear ended someone or ran a red light, then yes, its his fault.
Pedestrians can be legally at fault for causing a crash
It depends on the situation. If you stoped short and got rear ended it is your fault. But if you stoped becasue the driver in front of you stoped then it is that persons fault. If you are sitting at a stop light and get rear ended it is there fault. If you are parked in a parking zone and get rear ended it is there fault. Hope this Helped
You are both at fault you shouldn't have ran into the car and he/she should have had there lights on you are not at fault if it was dark or you couldn't see them
It really depends on the circumstances, I would contact your claims department for more information.
If you mean that someone was starting to merge into traffic and then they stopped and you rear-ended them, you would be at fault. If the person merging into traffic hit someone, the merger would be at fault because they failed to yield to oncoming traffic. These are typical scenarios. Other scenarios or circumstances may effect the outcome.
The police usually give a ticket to the person who got rear-ended. If they have insurance, the insurance company sometimes do an investigation to determine who was at fault for insurance purposes. Also, personally I would obtain an attorney who specializes in traffic law and ask their professional advice.
