Who is at war with Afghanistan?
Canada, allied with America, Europe, Afghanistan, and many other countries.
I know that may sound weird, but we are not at war with Afghanistan. We are at war with the Taliban, who are currently ruling Afghanistan.

The West is not at war with Afghanistan. On the contrary the West has committed a lot of aid and other resources to help Afghanistan. The West is at war with 'terrorism', however you might define it. The Taliban, who are active in Afghanistan and the greater region are a terrorist organisation. The West is at war with the Taliban.
Throughout the ages, Afghanistan has been no stranger to war. The current war in Afghanistan is preceded by the eleven-year Afghan Civil War between the Taliban and the US-backed Northern Alliance (aka the United Front). Before that, the Soviet-Afghan War lasted for ten years. Before that, Great Britain invaded Afghanistan nine times. No one can say when Afghanistan will ever know peace again.
If the War in Afghanistan were (legally speaking) a war, which it is not, then no, the War in Afghanistan would not be constitutionally legal as the President never declared war. However, the Constitution only recognizes wars against sovereign entities and as the War in Afghanistan is (and the War in Iraq was) a conflict to suppress non-state actors and therefore there is no breach in the Constitution.
