I have been down this route, my Dad died on 30/11/08 ages 49. His partner whom he had live with for 10 yrs said she was tooo upset to arrange the funeral, so myself, my grandparents, auntie's and uncles and his partner sat down to disuss what sort of funeral we would give Dad. His partner at this meeting said that Dad had left her £4000 cash at the house to pay for it (he hasn't been well for a while so saved up). Anyway, I then arranged the funeral. 4 weeks after the funeral I had the bill which came to just over £3000, I rang Dads partner and said the bill eas here and I would take it to her to which she replyed she has spent the money on the mortgage and bills as she hadnt been at work since Dad's death. I then told the rest of my family and they all tried to get some money out of her, but she refused to pay a single penny. As there was no will, the house was transfered into her name as the type of mortgage they had taken out allowed this to happen. I went to a solicitor to get advice costing me another £300 and the result was that although there were witnesses to her agreeing to pay, I had signed it to I was legally responsible. Myself, my husband and two children ages 5 and 3 are now in arreas with our mortgage and are going to have to move house to pay for this. While Dads partner has sold their house (as it was paid off by life insurance) and got a profit of £140,000. This was 6 mths ago she is now living with a new man in Spain in a luxary villa. Me im depressed, as I now think she never loved my Dad, have lost a baby as I was 5mths pregnant and all the stress casued me to misscarry, and it's all so unfair. If you do find a way around this I would be greatfull if you could reply back and I have tried every avenue I can think of.
