Lee and his Army of Northern Virginia, the only sizeable Confederate army still in action, were defeated by the Army of the Potomac, commanded by George Meade.

Some say that Meade should therefore have taken the surrender.

However, Lee was also General-in-Chief of the Confederates, so others say that U.S. Grant, as General-in-Chief of the Union, was the right one to do the honours - as he did, at a poignant meeting between America's two top soldiers.

As General-in-Chief of the Union armies, Ulysses Grant took the surrender of Robert E. Lee as General-in-Chief of the Confederate armies.

Lee was also commander of the Army of Northern Virginia, and it was this army was defeated by the Army of the Potomac under George Meade, with Grant travelling alongside in a mobile HQ. Some said that Lee should have surrendered to Meade.

Lee had also been defeated by the newly-promoted Meade at Gettysburg in July 1863.
