What model and year is your BMW? On BMW's there is no way to check the Transmission Fluid except by getting the car on a lift and opening up the drain plug and sticking your finger inside. Check your transmission lines, on many cars, they are often leaking fluid and it will get to a point where there is not enough fluid to get the torque converter working. The transmission fluid lines are almost exclusively located on the drivers side frame rail, under the air box. If you have seepage at the ends, then you need your lines replaced and your transmission oil cooler replaced also.

i had this issue with my RR. i had to replace the transmission ECU at the dealership. the transmission could not or would not allow the car to get out of first gear. after burning through first gear and getting up to speed, it may get out of first gear. over time, this will damage your transmission.

It is called the passing gear.
Reverse is usually the first to go, followed by first gear. Time for a transmission rebuild.
Check your clutch fluid level or your automatic transmission fluid level.
That would be the second gear of your automatic transmission.
The real problem is manually shifting from gear to gear with an automatic transmission. If you are referring to the automatic upshift, there may be a problem with the EGR system or vacuum system.
