Type your answer here... Most likely answer is that you have a badly clogged transmission filter. When the fluid is cold it is thick and may not be able to get through the filter, starving, the pump, etc., and causing the trans. to slip, just like it was low on fluid. As the fluid warms up, it gets thinner, and is more able to get through the clogged filter, allowing the trans. to operate "normally". Hopefully a filter/fluid change will do the trick. (should be a little less than $100) Don't delay in getting this done. If you procrastinate you will have a much higher probability of needing a total rebuild/ replacement of your tranny. When a auto trans is cold the clutch bands hold better but after they get hot they slip. Find a transmission shop asap.
Your transmission might slip on your ML320 because the transmission fluid is low or because the transmission is damaged. The most common cause of transmission slip is wearing of the transmission.
Try to replace the oil filter if the transmission is not engaging when it's cold.

Automatic: Either transmission fluid level or oil pressure. If the fluid level is OK get a transmission service. That will either cure the fault or show where it is. Manual: Weak clutch cover diaphragm springs.
