Communist attitudes to religion changed according to political whim and necessity.

Until the 1930's, communist Russia persecuted the Church, but during the war Stalin realised that the Church could be of positive help to the state in mobilising public support for the defence of the country. Even after the war, it was recognised that the Church would continue to be of help in furthering the Soviet political agenda.

In China, many churches were pulled down during the brief period of the Cultural Revolution, and whether or not religion was constitutionally legal was to be no impediment. However, the churches were soon rebuilt and flourish today. Only Falun Gong is regarded as a truly illegal religion, perhaps understandably (if not justifiably) because of the faith's virulent criticism of the government.

Cambodia, under Pol Pot, suppressed all forms of religion because only the state should control the minds of the people. Religion is also banned in North Korea, no doubt for the same reason.

Is the current war constitutionally legal?

If the War in Afghanistan were (legally speaking) a war, which it is not, then no, the War in Afghanistan would not be constitutionally legal as the President never declared war. However, the Constitution only recognizes wars against sovereign entities and as the War in Afghanistan is (and the War in Iraq was) a conflict to suppress non-state actors and therefore there is no breach in the Constitution.

Why did slave states like Kentucky and Maryland fight for the Union?

The so-called slave border states did not add much in military power to the Union's war efforts. Kentucky was "neutral" in a manner of speaking and Maryland was an occupied Union state. In Missouri, people on both sides of the war contributed to each side.
