There are numerous reasons why police would let someone go even if they are caught commiting a crime. Some points on this are-

It is against the law to attempt or aid someone commiting suicide

Wait for it to get flagged when it is bought/sold or wait for someone to get caught with it by the police. The police typically check the serial number of a gun when it is found or somehow involved in a crime or traffic stop.
Now, i can't answer for God, but in my catholic opinion, he hates the sin but loves the sinner. so to be with someone in the act of a crime is most likely devestating to Him but when they repent and try to do better, then he is joyful. so no, He probly is not joyful to be with someone in the act of commiting a crime.
