No credit agency will sue you. I believe you mean collection agency. Send the collection people a Cease and Desist letter (google "fair credit act cease desist). Then get a free credit report (your right!!)(the score doesn't matter so don't pay to get it). Then dispute the debt w/ the credit bureaus (the dispute letter will be found w/ the Cease and desist letter).

I called the collectors (citi bank) and they told me i can go and dispute it

I am in the middle of a dispute at this time over the same question. I did not know that our insurance company had not paid a service provider 100% of the charge. Two years later I receive a notice from a collection agency. The collection agency stated the company mailed 11 statements and after the last statement was returned and another 7 months they turned it over to a collection agency. All they had to do was call the insurance company they had received payment from to verify our address or the referring physician. Now because of their handling, the appeal period for the insurance claim has passed and my credit is being adversely effected. Was this vehicle a repo at the time and were you paying the remaining balance to the collection agency or was the account a charge off? I am assuming that you are refering to Ford Motor Creit which I used to collect for. In most cases a 3rd party collection agency will purchase the account at pennies on the dollar or the account will be placed with a fee once the account is collected. It is the collection agency responsiblity to update the creditor of payments and in some cases update credit reports. Also it is a good idea to get a confirmed paid in full letter and to send it to the original creditor to make sure they update your credit report correctly.

Legal or not, this happens every day. Inform the collection agency and the original lender that this was included in the bankruptcy. The collection agency may want to see proof but usually the original lender will call and request that - that particular account be sent back. Make sure you get something in writing from the original lender--and that the collection agency REMOVES their account off your credit report--check your report 3 to 6 months later, to make sure this has been done. If you don't want to wait--send a copy of the signed letter on the lender's letterhead to all 3 collection agencies and wait for their response. Even though it will take about 30 days--this is the quickest way.

I moved out of my apartment in 1993 and unknowingly left a 123.00 phone bill. Last year, SBC took over Ameritech and they said they had new "collection procedures" and contacted me at my house. This is 12 years later. It was actually a collection agency that contacted me. When I checked my credit report a few months ago, it was listed as a collection and there was several collection "marks" listed for the last few months, so it does occasionally get placed on credit report. I paid it the 1st day they called my home by the way and it was still reported as a collection and that they were "unable to locate" me.
