Before an assessment of responsibility is made one would need to have a clearer definition of "timely manner". For instance, was the attorney aware that the client needed to be notified within a specified time frame? Did the client keep regular contact with counsel, or were they able to be easily contacted so he or she could be apprised of developing issues? Attributing fault is not neccessarily an easily substantiated claim.
