You can never get your say in the matter of when you want to live with your non custodial parent. That is determined by the court. The court determines which parent you will live with. There is a divorce decree issued by the judge. That determined which parent has custody. Now, if there is a good reason why you want to live with your mom that would convince the judge to change his or her mind, that is another story. The judge can change your custody. It will not happen on a whim. If you are being abused, you will need to contact HRS or the equivalent agency. That agency will get the judge to change the court order. Or, your mother may be willing to petition the court to change the custody arrangements. The judge might do that after he has heard your reasons. .........................
