Can you use youe security deposit as rent if you dont have any money and your moving out?

Tenants often think this would be a good idea. What if you leave the place a mess or don't move once the deposit is consumed? As your landlord I would begin eviction as soon as you didn't pay your rent.

∙ 14y agoI only know Massachusetts law, but we have one of the most strict security deposit laws around, so this should be good for any state.
If you evict for non-payment, the tenant still owes the remaining months, although you have an obligation to attempt to rent the place. If you don't, then you can apply the deposit to the arrearage. You'll need to write them a letter stating the accounting, including interest on the deposit. If they have not given you a forwarding address, mail it to the subject address.
