You will get the chair.
That depends, possession of what? firearms? marijuana? cocaine? Alcohol?
Is possession of alcohol considered a felony or misdemeanor?
Marijuana is always better than alcohol and cigarette smoking.
Except for the underage possession of alcohol charge, your age is of no relevance - you are legally an adult. There are no set punishments or sentences for criminal offenses. The court must consider the relevant state law, the facts and circumstances of the offense, and any other mitigating or aggravating factors surrounding the offense. In most (all?) cases, possession of less than one ounce of marijuana and minor in possession of alcohol are both misdemeanors. Typically, these crimes are not punished harshly, but generally bring about a fine, community service, and/or probation. However, even as misdemeanors, they can each be punished by up to 12 months in confinement.
Alcohol causes you to become disoriented. Marijuana makes you sleepy. If you drive while on alcohol you cant control the car or your speed. Marijuana can make you drive slower.
There is a law against possession of marijuana in the United states because it has been historically linked to narcotics and is perceived as addictive. In addition, many long-time bans are often kept despite illogical reasoning, ie. the ban on sodomy, which was only ruled unconstitutional in 2003. Alcohol was previously banned and the ban caused a public uproar, and a ban today would produce similar reactions.
A blood alcohol test doesn't detect marijuana.
Maybe.... did they see you throw it out of the vehicle or - were you near enough to it so that you were in "constructive possession" of it?
About 90% of them would deny it.. Who would want to go to juvenile hall for doing a drug that shouldn't be illegal in the first place. Look at alcohol its 10 times worse. ..Yet it's legal. Hypocrites.
When a minor is in possession of alcohol, the charge goes on the minors juvenile record if the minor is under the age of 18. For people over the age of 18 in possession of alcohol, it goes on your permanent record in New York State.
Alcohol and marijuana are both depressants and can increase drowsiness, confusion and anxiety.
The Juvenile judge may cut you some slack but the chance you'll get off with nothing is slim and none.
