The fact that slaves were counted at all in determining congressional representation. The Northern states argued that since slaves were denied the right to vote, and all other rights, they were not part of the body politic and hence should not be counted in determing a state's population for representation in congress. The Southern states naturally wanted to count the slaves so they would get more congressmen. They compromised by saying that three fifths of the number of slaves would count for purposes of representation in the House of Representatives. How they settled on three fifths I have no idea but please note that this in no way implied that a black man was only three fifths of a human being.
