Criminal Records Bureau (CRB) checks were replaced by Disclosure and Barring Service (DBS) checks in 2012. DBS checks will show all cautions, warnings, reprimands and final warnings that are not eligible for filtering.

A caution, reprimand or final warning for 'Common Assault' will become eligible for filtering (and stop showing up) if:

  • it was not against a child or young person, and;
  • it has been 6+ years since the caution/reprimand/final warning was issued (or 2+ years if the individual was under 18 when caution).

A conviction for 'Common Assault' wil become eligible for filtering (and stop showing up) if:

  • it was not against a child or young person, and;
  • it has been 11+ years since the date of conviction (5.5+ years if the individual was under 18 when convicted), and;
  • the conviction did not result in a custodial sentence (whether served or otherwise), and;
  • the idnividual being DBS checked does not have any other conviction offences.

How far back in life do CRB checks go?

Some employers only want your most recent 5 years or 10 years. However your accessible adult criminal history record can reach all the way back to your 18th birthday. That's why its called your "history."

Is DBS legislation?

The Criminal Records Bureau (CRB) was established under part V of the Police Act 1997.The Independent Safeguarding Authority (ISA) was established by the Safeguarding Vulnerable Groups Act 2006.The Disclosure and Barring Service (DBS) was established by the Protection of Freedoms Act 2012 to take over the duties of the CRB and ISAThe Rehabilitation of Offenders Act 1974 (Exceptions) order 1975 allows for DBS checks but does not insist on them.The Safeguarding Vulnerable Groups Act 2006 insists on DBS checks for certain positions but for most others, DBS checks are not required by law.Even if a check is not required by law, if the employer has not taken adequate steps upon recruitment (i.e. DBS checks) they can be liable if anything goes wrong.A lot of organisations that have people working in positions that can be DBS checked have regulating bodies (i.e. Ofsted, CQC, etc) who have their own policies towards checking.

Was fined over 30 years ago will show on crb check?

It depends what the original offence was. Most offences have a 'time limit' on a person's criminal record. For example - a friend of mine was arrested 13 years ago who is now 54. When they checked his history for previous convictions, it failed to show an arrest that happened when he was 19. ~ As stated above unless the CRB check is classified as an "enhanced CRB Check" - These are often used for sensitive work roles

What is shown on a basic crb check?

A basic CRB check will show any unspent criminal convictions or conditional cautions. It does not show spent convictions, cautions, or other relevant information. The exact information revealed depends on the level of check.
