No, but same-sex civil unions are legal.

On October 21, 2008, the country of Ecuador adopted a new Constitution. That new Constitution explicitly bans same-sex marriage, but legalizes same-sex civil unions. By definition, those civil unions have the same rights and responsibilities as marriages, except that the adoption of children is limited to opposite-sex couples.

The Constitution was implemented in September 2009, with the first civil union taking place in October 2009.

Currently, these South American jurisdictions permit same-sex couples to marry (in chronological order):

  1. Argentina (July 22, 2010).
  2. Brazil (May 14, 2013, although some states started earlier);
  3. Uruguay (June 19, 2013); and,
  4. Colombia (June 20, 2013).

There are other jurisdictions that grant same-sex couples rights and responsibilities similar or even identical to legal marriage, but the jurisdictions listed above are the only ones where same-sex marriage is currently legal in South America.



Currently, these South American jurisdictions permit same-sex couples to marry (in chronological order):

  1. Argentina (July 22, 2010).
  2. Brazil (May 14, 2013, although some states started earlier);
  3. Uruguay (June 19, 2013); and,
  4. Colombia (June 20, 2013).

Yes, since July 22, 2010.

Previously, civil unions were legal in Buenos Aires and the province of Rio Negro (as of July 14, 2003) and in the city of Villa Carlos Paz (as of January 2008).

No. The Venezuelan state of Merida permits same-sex civil unions and bills have been introduced in the federal legislature that would create a kind of civil union called asociaciones de convivencia. President Hugo Chavez has stated he is in favor of the bill.
