What does the term clear and present danger have to do with censorship?

"Clear and present danger" is a test derived from Justice Oliver Wendell Holmes, Jr's opinion in the Supreme Court case Schenck v. US, (1919), that first set established legal exceptions to, or restrictions on, the exercise of First Amendment free speech depending on the content and context of the speech. In other words, "clear and present danger" was the standard used to determine whether free speech could be censored or punished.

Holmes' simplest analogy involves "shouting fire in a crowded theater," an activity that (in the absence of fire), could put people in danger and lead to injuries. Holmes asserted the First Amendment was never intended to protect that kind of free speech.

In Schenck v. US, the Supreme Court upheld the 1917 Espionage Act as constitutional and affirmed the convictions of Charles Schenck and Elizabeth Baer for distributing anti-war pamphlets that encouraged conscripted soldiers to resist the draft and refuse to fight in World War I. The Court held their speech wasn't protected because it threatened to interfere with military recruiting.

What is book banning or book censorship?

Book banning can be when you aren't allowed to read a book or someone says a certain group of people can't read certain books. Such as when you go into an elementary library, you won't find a book that has content like sex. Other wise, for those grade levels the book is 'inappropriate' so it is banned. Censorship is when someone removes, replaces, or blocks all the content from a book or publication that they deem inappropriate or offensive (such as bleeping out a profane word in a sitcom or putting a black bar on a girl's naked breasts in a movie.)

What is a sentence with censorship in it?

  • Censorship is getting out of hand.
  • The censorship of the television was a bit far-fetched.
  • Censorship exists to protect people from harmful content.

Are hate speeches that people make against others justified?

Hate speeches against specific individuals and groups of people are almost always reprehensible. I cannot imagine a situation where hate speech against a person, national group, ethnic group, or religious group. However, in the war of ideas, speaking passionately about ideas which you reject, even in the darkest terms, can be justified in the pursuit of free inquiry and debate. The speaker should make it clear, though, that he is addressing the ideas or concepts and not the particular individuals.

Does censorship help us or hurt us?

Media censorship has become a major problem, due to the fact that the media we view in the mornings, evenings or read daily are not full facts. Our media is hiding the truth for the simple fact that they think they are trying to protect us however they are only harmimg us by not giving us the facts, when at the same time they expect us to comprehend what they are trying to tell us.

The censorship we expeience today based on what is was 20 years ago has a vast difference and not on a positive level. It is best to be told all facts and havw to bare with certain things, then be told non and it come as a a suprise at the wrong moment in time.
