Well there are several different variables to your question. Those variables range from, will the deer react from hearing the bow string and run away causing your arrow to have bad placement or not even touch the deer. Another factor is what kind of arrow are you using, if you're using an aluminum shaft you wont have such a flat trajectory you get from per say carbon arrows. But one of the common myths in bow hunting is that you can penetrate more using an aluminum because it has more kinetic energy but for power you sacrifice distance. and aluminium shaft could penetrate a deer with a 2 blade broad head just as well as a carbon shaft, except carbon shafts don't lose as much velocity and fps as aluminums do. If you go to light a shaft you don't have as much KE. So stay in-between 7-14 grains per pound when choosing arrows. Bottom line is if you have a somewhat flat trajectory at 25 yards, your arrow placement is good, and you have a good broad head I can't see why not.
I hunt mule deer because im in alberta and i 50lbs and it leaves a good blood trail and i have had a few arrows go through using a easton carbon n fused shaft. I don't see 10 pounds under that is going to much of a problem when killing deer. If you're still unsure check your fps for your 40lb compound and if it is above 300 fps for your set up you should be fine.
